Marriage in Austria
Legal Age for Marriage:
The legal age for either sex is 18. Persons at least 16 years of age may also marry on presentation of written, notarized consent from both parents and if the other spouse is at least 18 years old.
Required Documents:
- Birth certificate (including parents' name).
- Proof of residence (driving license, voter's identification or slip of council tax bill).
- Copy of passport (copies of pages including date and place of issue, certified by court or notary public).
- Marriage certificates of any previous marriages.
- Proof of dissolution of any previous marriages (death certificates, final divorce decrees).
- Notice of the Austrian Ministry of Justice relating to the recognition of the foreign divorce decree (not required, if, at the time of the divorce, both spouses were citizens of the country of the ruling court).
- Certificate of No Impediment which must not be older than 6 months, issued by the local Registry Office.
Depending on the circumstances further documents may be required!
Please send all documents (originals or certified copies) with a complete certified translation into German at least 8-10 weeks prior to the intended date of marriage to the approriate registrar's office (Standesamt).
Please note: The Embassy has no jurisdiction in registrar undertakings. Enquiries concerning the marriage should be addressed to the registrar's office concerned in Austria or the main registrar's office in Vienna.
Place of Marriage:
Austrian law recognizes only civil marriages. A religious ceremony may be performed only after a civil marriage has been solemnized. Civil marriages are performed at the registrar's office (Standesamt) in the appropriate jurisdiction.
If either party to the marriage is an Austrian citizen or resides in Austria (regardless of citizenship), the application for marriage must be filed at the Standesamt which pertains to that residence. If both parties to the marriage are neither Austrian nor residents, the application must be filed at the main registrar's office in Vienna:
