Is my divorce valid in Austria ?
Since the new Non-contentious Proceedings Act came into force on 1 January 2005 an obligatory recognition process conducted by a court, recognising foreign decisions concerning matters of marrige in Austria, according to § 97 Abs. 1 AußStrG, is no longer necessary in most cases. This simplified recognition, which no longer requires legal proceedings to be carried out, is henceforth implemented by a civil registrar who verifies the conditions for marriage. However, should any doubt with regards to the creditworthiness of a decision arise, then the recognition process may be reverted back to its previous legal position where an application for independent legal proceedings in a court can be filed, according to § 98 AußStrG.

Court fees hold a flat-rate oft € 72,-. Additionally, upon consultation of the Austrian Embassy, consular fees may also be charged.
